Ticketing and Attendance Terms and Conditions

Acknowledgement of Country 

QA acknowledges the Aboriginal and Torres Strait Islander ancestors as the traditional custodians of this land. 

We pay our respects to ancestors and Elders, past and present and are committed to honouring the Australian Aboriginal and Torres Strait Islander peoples’ unique cultural and spiritual relationships to the land, waters and seas and their rich contribution to this society.


Ballet International Gala (the “Event”) is owned and operated by Queensport Arts Pty Ltd (“QA").

By purchasing a ticket to the Event, you agree to be bound by the following Terms and Conditions. 

These Terms and Conditions apply to the sale of any tickets purchased for the Event, as well as your attendance at the Event more generally. With that in mind, please review this information carefully and before finalising your purchase with QA. 

QA reserves the right to update or modify these Terms and Conditions from time to time. Such variations will take immediate effect following their publication on the Event website and will apply to any purchases made after that date.

Ticket Orders

To attend the Event, you must first purchase tickets from QA (or its authorised agent) on the Event website, and through our ticketing partner EMedia Campaigns Pty Ltd (“EMedia”), or in any other manner provided for by these Terms and Conditions (including any variations thereof). QA reserves the right to deny entry to ticketholders who have failed to comply with this condition. 

You acknowledge and agree that all ticketing orders are subject to applicable law and availability. QA reserves the right to vary the number of tickets available for purchase at any time, in its absolute discretion or as required by applicable law. 

QA warrants that the proceeds from the Event’s tickets sales will be held in a separate ticketing account. If QA is required to refund a ticket, it will do so directly from this ticketing account. 

You acknowledge and agree that once your order is confirmed, your ticket and any transaction fees will not be refunded or exchanged, except as provided for in these Terms and Conditions, or as required by applicable law. 

Before purchasing tickets to the Event, you will be required to establish a user account on the Event website. By establishing an account, you acknowledge and agree that you must maintain the confidentiality and security of your user account and that you must not provide any third party with access to the same, without your express consent.

You are otherwise responsible for your own use of the Event website and all transactions conducted through your account. If you become aware of any unauthorised use of your account, you must notify QA immediately and reset your password.

Ticket Prices and Payment

All of our ticket prices quoted are in Australian dollars and include applicable GST. If you require QA to issue a tax invoice confirming your purchase, please email our management team, who will provide you with a copy of the same, as soon as reasonably practicable upon receipt of your written request. 

QA reserves the right to vary its ticketing prices in its absolute discretion and otherwise, without notice.

Before purchasing a ticket to the Event, you acknowledge and agree that a transaction or booking fee may be applied to your purchase order and that you will be notified of the applicable fee prior to purchase. If QA agrees to exchange your ticket, an exchange fee may apply.

By confirming your order, you warrant to QA and EMedia that you have the express authority or permission from the card owner or other payment facility used to purchase the ticket. If QA reasonably and lawfully suspects that a ticket has been purchased with a stolen card; or has been sold in breach of these Terms and Conditions or has been otherwise purchased or acquired fraudulently, QA may cancel the ticket without refund.

If, for whatever reason, you purchase a ticket for an amount which QA determines to be incorrect, QA may cancel and refund to you the purchase price of your ticket and may offer you a replacement ticket at the correct price. 

Ticket Format, Delivery and Replacement

Your tickets will be ready for delivery to your nominated email address (e-ticket). upon QA receiving payment of the purchase price in full. 

By purchasing an e-ticket, you acknowledge and agree that you are responsible for presenting a legible copy of the same (in hard or digital copy) and bringing it to the venue on the evening of the performance, in order to gain entry to the Event. 

QA reserves the right to ask all ticketholders for their proof of identity and proof of purchase before they are permitted access to the Event, and to refuse entry to unauthorised or duplicate ticketholder 

Where tickets are lost, stolen, misplaced or destroyed, QA reserves the right to charge an administration fee to issue a replacement ticket and will require proof of identity and purchase, prior to issuing a replacement ticket.

QA reserves the right to refuse issuing a replacement ticket if the ticket is designated for general admission as opposed to allocated seating or where QA deems (in its reasonable opinion) that your request for a replacement ticket has not been received within a reasonable period of time prior to the Event.

Event Ticketing Refunds and Exchanges 

QA acknowledges the impact and uncertainty which the recent COVID-19 pandemic has created within the entertainment industry and its stakeholders in general. With that in mind, QA may be required to take actions in relation to the timing and format of the Event in order to comply with the applicable laws of various countries who are struggling with pandemic (which may change from time to time) and which may impact QA’s ability to deliver the Event in the precise manner specified on the Event’s website (as varied from time to time). 

While QA endeavours to deliver the Event in the manner advertised (from time to time), by purchasing a ticket, you acknowledge and agree that QA reserves the right to add, withdraw or substitute artists or vary its advertised programs, performance times, venue, seating arrangements or audience capacity at its discretion but otherwise subject to applicable law. 

You acknowledge and agree that your tickets will not necessarily be refunded as a result of these changes, except as required by applicable law (which includes, any rights pursuant to Schedule 2 of the Competition and Consumer Act 2010 (Cth)); and that any refund is otherwise made at the discretion of QA. 

Notwithstanding this, if the Event is cancelled, QA will offer you (and other ticketholders) a full refund. If, however, the Event is rescheduled to another date, QA is not automatically obligated to provide such refund and instead, reserves its right to re-issue your ticket for a future date and otherwise manage your and other ticketholders’ requests for refunds at its discretion (subject to applicable law). 

If the Event, is postponed, cancelled or relocated to another venue, QA will use its reasonable endeavour to notify you of such change based on the information which you have provided to us at the point of sale (so please ensure all of this information is accurate and that we are kept up to date of any changes). 

You may be entitled under applicable law to a refund or exchange where the Event is materially varied in the manner contemplated by this provision. If, however, the Event is relocated to another venue, neither QA nor EMedia will reimburse you for any ancillary expenses (such as the cost of travel, car-parking, child-care and accommodation) or other consequential loss suffered by you in connection with your attendance or non-attendance at the Event. With that in mind, QA strongly recommends that you obtain ticket and/or travel insurance cover against loss for such expenses.

If you or a member of your booking party is diagnosed with COVID-19 or has been in close contact with anyone who has been diagnosed with COVID-19, QA will offer a full refund to the parties concerned, provided that one or more of such parties were not diagnosed prior to booking, and provided that you and your booking party have complied with any COVID-19 safe directions and otherwise the balance of these Terms and Conditions.

QA is not liable to exchange or refund to you any amount beyond the purchase price of the ticket inclusive of any booking fee.

QA may cancel any ticket which it reasonably believes has been purchased or sold in contravention to these Terms and Conditions. In such circumstances, QA will not be required to refund the ticket price to the bearer, but may do so if, following its investigations into the matter, it forms the view that it would be appropriate to do so. 

Unauthorised Sales

You acknowledge and agree that any tickets to the Event must not be resold or offered for resale at a price higher than that which is stated on the ticket, without QA’s prior written consent. If you have any questions concerning this provision or would like to enquire about obtaining such consent, please do not hesitate to contact our management team.

QA reserves the right to seize or cancel a ticket from the bearer without refund or exchange and deny the bearer access to the Event, if a ticket is sold or used in contravention of this provision.

Conditions of Entry

The venue’s conditions of entry have been incorporated into these Terms and Conditions, and therefore apply to the sale of your ticket and entry to the Event. You may request a copy of the venue’s original terms from QA, by emailing our management team who will attend to your request as soon as practicable. 

General Terms

By attending the Event, all persons attending the Event (‘Attendees’), (including talent, crew and other third parties who visit the venue during the Event) agree to be bound by QA’s general terms and conditions of entry, as well as all applicable laws, regulations, codes of practice, rules, requirements which apply to the venue and otherwise, and comply with all reasonable directions issued by the venue, the venue’s personnel and QA from time to time.

All Attendees grant QA and the venue’s staff, permission to conduct a reasonable search of the Attendee’s personal belongings prior to entry. If an Attendee refuses to be searched, then QA and/or the venue may refuse the Attendee access to the venue during the Event.

If an Attendee is in possession of any prohibited items, QA or the venue’s staff may confiscate the items, or otherwise refuse the Attendee entry or request the Attendee to leave the Event. Prohibited items include but are not limited to: any type of item deemed unlawful by applicable law, any item which could reasonably interfere with performance, enjoyment of the Event or endanger other Attendees, any animals, food and/or beverages which are not distributed by QA. QA reserves the right to deem items as prohibited at its discretion.

Please note that for the purposes of this Event, the entire venue have been designated as a non-smoking zone. 

Any illegal activity or possession of illegal items by an Attendee may result in QA or the venue notifying the relevant authorities of such activity. 

All Attendees acknowledge and agree that they must refrain from any form of inappropriate behaviour at the Event including, but not limited to, bullying, harassment, disruptiveness, being intoxicated or substance effected, or any other behaviour reasonably deemed as inappropriate by QA. Such behaviour may result in the Attendee being escorted from the venue at QA’s discretion. Attendees found to be in attendance without the correct ticketing may also be escorted from the venue. Once removed from the venue, attendees may only re-enter the Event at the discretion of QA. 

If an Attendee appears at the Event while the performance is in progress, QA and the venue reserves the right to delay the Attendees entry to the venue until such time that there is a suitable enough break to enable the Attendee to make their way to their seat, without disturbing the performance. 

COVID-19 specific conditions of entry

You acknowledge and agree that the Event may be scheduled to be held, or will be held, during a time at which one or more Government directions or regulations may be in force regarding the number of persons attending an event (or the holding of the event itself). If that is the case, then the number of persons permitted to be in or around the Venue may be affected, resulting in QA being required to:

  • cancel or postpone the event;
  • reduce the number of persons who may attend the event; 
  • change your seating allocation; and/or
  • change any standing or seating configurations for attendance at the event;

in which case you may receive a refund in accordance with these Terms and Conditions, or the COVID-19 Refunds and Exchanges Terms and Conditions, as the case may be.

You agree to comply with all applicable laws, including but not limited to government directions, orders and regulations relevant to attending live events, which may be in place at the time of and be applicable to the Event. 

If you are attending the Event as part of a group, as the primary ticket purchaser, you are responsible for knowing the contact details of all attendees in your group. In the Event you are contacted directly by the Government, including the Department of Health for the purposes of contact tracing, you must: (a) make the contact details of your group available to the Government (if you have the consent of each group member to do so); or (b) contact each member of your group, and request that they provide their contact details to the Government directly.

All Attendees in your group, including yourself, must commit to stopping the spread of COVID-19. If at the time of the event, either you, or any other members of your group are feeling unwell or are subject to a self-quarantine or self-isolation period, you agree not to attend the event. If you do attend the event, you agree to assume all risk associated with COVID-19. 


All Attendees under the age of 13 (“Minors”) who attend the Event must be accompanied by a parent or adult, legal guardian (“Guardians”). Guardians accept full responsibility for the safety and wellbeing of Minors in their care and agree to supervise them at all times during the Event. 

The Terms and Conditions apply, in their entirety, to all Minors. Guardians accept full responsibility for ensuring Minors in their charge comply with all of the Terms and Conditions and applicable laws. 

Guardians agree to hold QA, the venue’s personnel, harmless from any and all liability for loss, liability, claims, demands or expenses incurred by a Minor in his/her charge or caused to third parties by a Minor in his/her charge, in the course of that Minor’s attendance of the Festival, or any breach by that Minor of these Terms and Conditions. 

A Minor’s attendance at the Event may be subject to additional conditions of sale and entry, which will be published on QA’s website or otherwise brought to your attention by QA’s management team (via email). 


QA will not refund or exchange any merchandise purchased at the Event, unless it is otherwise required to do so by applicable law (which includes Australian Consumer Law).


By purchasing a ticket to the Event, you consent to the collection, use, disclosure and handling of your personal information in accordance with the terms of our Privacy Policy (which are available from the Event website). 

Assumption of Risk

By purchasing a ticket and attending the Event, you acknowledge and agree that you will enter the venue at your own risk.

You acknowledge and agree that very nature of the venue and the live performance may give rise to certain risks or dangers, which includes but is not limited to risk of injury and damage to you or your property. 

While QA, EMedia and the venue will take all reasonable steps towards mitigating such risks, you otherwise agree, that by attending the Event, that you accept the risk of damage and loss (including property damage, personal injury, economic and consequential loss) in whatever form it arises at the venue. This includes damage or loss caused by the acts or omissions of other ticketholders, visitors, guests, and the employees and agents of QA, EMedia and the venue.

Limitation of Liability

To the extent permitted by law, neither QA, EMedia nor the venue are liable to you for any loss, damage, injury, delays, additional expenses or inconvenience arising as a result of your attendance or non-attendance at the Venue and/or the event. 

Where liability cannot be excluded or modified by law, the liability of QA and the venue is limited to the maximum permitted by law.


If any provision or any part of any provision of these Terms and Conditions is in any way unenforceable, invalid or illegal, it is to be read down so as to be enforceable, valid and legal. If this is not possible, the provision (or where possible, the offending part) is to be severed from these Terms and Conditions without affecting the enforceability, validity or legality of the remaining provisions (or parts thereof) which will continue in full force and effect.

These Terms and Conditions are governed by the laws of Queensland Australia and the parties submit to the non-exclusive jurisdiction of its courts in any dispute concerning the subject matter of this Agreement.
